Please read these Terms of Service carefully before using the GEXCO Mercantile website. By accessing or purchasing from gexco.com, you agree to be bound by these terms. If you do not agree, please do not use our services.
1. Eligibility
You must be at least 18 years old and capable of entering into a legally binding contract to use our services. By placing an order, you confirm that you meet these requirements.
2. Products & Pricing
All product descriptions, images, and prices are subject to change without notice. Prices are displayed in Nigerian Naira (₦) and are inclusive of applicable VAT unless stated otherwise.
We reserve the right to limit quantities, refuse orders, or cancel orders at our discretion — including in cases where product information or pricing contains errors.
3. Orders & Payment
An order confirmation email does not constitute acceptance of your order. Acceptance occurs when we dispatch your item(s). We reserve the right to cancel any order prior to dispatch.
Payments are processed securely through our third-party payment partners (Flutterwave, Paystack, OPay). By providing payment information, you represent that you are authorised to use the payment method.
Pay on Delivery (POD): POD orders require a non-refundable 30% deposit at the time of order. The remaining balance is due upon delivery. Failure to accept delivery or pay the balance may result in a restocking fee.
4. Shipping & Delivery
Estimated delivery times are indicative only. GEXCO is not liable for delays caused by logistics partners, weather, or other factors outside our control.
Risk of loss and title for items pass to you upon delivery to the specified address. For warehouse pickup orders, risk transfers at the time of collection.
Free shipping is available on eligible orders as indicated at checkout. Shipping fees are non-refundable except in cases where GEXCO is at fault.
5. Returns & Exchanges
We offer a 30-day return window from the date of delivery. Items must be unused, unwashed, and in original packaging with all tags attached.
The following items are non-returnable: customised or bespoke pieces; items marked as final sale; and items damaged through customer use or mishandling.
To initiate a return, email support@gexco.com with your order number and reason for return. We will provide instructions within 2 business days.
6. User Accounts
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorised use of your account.
We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent, abusive, or unlawful behaviour.
7. Reviews & User Content
By submitting a review or any other content to our platform, you grant GEXCO a non-exclusive, royalty-free licence to display and use that content in connection with our business.
You agree not to post content that is false, defamatory, abusive, or in violation of any third party's rights. We reserve the right to remove any content at our discretion.
8. Intellectual Property
All content on gexco.com — including text, images, logos, and design — is the property of GEXCO Mercantile or its licensors and is protected by Nigerian and international intellectual property laws.
You may not reproduce, distribute, or create derivative works from our content without prior written permission.
9. Limitation of Liability
To the maximum extent permitted by law, GEXCO Mercantile shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
Our total liability for any claim arising from these terms shall not exceed the amount you paid for the relevant order.
10. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes shall be subject to the exclusive jurisdiction of the courts of Enugu State, Nigeria.
11. Changes to Terms
We may update these Terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the revised terms. We will notify you of material changes by email where possible.
